this notice will incorporate the provisions
of the State Labor Code. Compliance
with the prevailing rates of wages and
apprenticeship employment standards
established by the State Director of
Industrial Relations will be required.

Prevailing Wage: Federal Labor
Standards Provisions, including

The Contractor’s duty to pay State
prevailing wages can be found under
Labor Code Section 1770 et. Seq.

Five percent (5%) will be deducted from
each progress payment and retained by
the City. The remainder less the amount

Public Hearing Notice
The PLANNING COMMISSION will hold a public hearing on:
Amending and possibly eliminating the affordable housing requirement within
the 540 East Imperial Avenue project
Project Address: 540 East Imperial Avenue
Project Description: On September 28, 2016, the El Segundo City Council approved land use
entitlements, a Development Agreement and a Specific Plan for the development of 34 multi-family
dwelling units and 24 single-family dwelling units at 540 East Imperial Avenue. As a condition of approval,
the developer was required to provide six units of affordable housing, consisting of two units for qualified
extremely low income households, two units for qualified very low income households, and two units for
qualified low income households.
The applicant requests an amendment to the conditions of approval, the Development Agreement and
Specific Plan, and requests eliminating the requirement that the developer provide 6 affordable units within
the residential development. Instead, the developer proposes to pay the city an in-lieu fee and not provide
any affordable units in the development. In response, staff is proposing an option of changing the level of
affordability for the six units to moderate income units.
Please note that the Planning Commission is not the final decision making body for this request. The
Planning Commission will consider the requested amendment and will make a recommendation to the City
Council. The Planning Commission’s recommendation on the project will then be presented to the City
Council for action at a future public hearing. Public notice will be provided of future City Council meetings.
