Labor Code Section 1770 et. Seq.
and Labor Code Sections 1775 and
1777.7 outline the penalties for failure
to pay prevailing wages and employ
apprentices including forfeitures and
debarment.
Note that the Project is subject to
compliance monitoring and enforcement
by the California Department of Industrial
Relations. Pursuant to California law, the
City must find bids failing to comply with
all applicable Labor Code requirements
including, without limitation, Labor Code
§§ 1725.5 and 1771.4, to be nonresponsive.
Five percent (5%) will be deducted from
each progress payment and retained by
the City. The remainder less the amount
of all previous payments will be paid

Contractor may substitute securities

experience. “The position is pretty much
exactly as I thought it would be with a series
of interesting challenges,” he said. “There are
lots of complicated large land use projects and
issues. The executive team is first-rate and has
been very welcoming. There are a number of
public infrastructure challenges that need to be
dealt with sooner rather than later.”
Tackling the infrastructure issues is a top
short-term priority for Mitnick, as is building
strong management teams and hiring talent
to lead the organization into the future. For
the long haul, he stated his commitment to
addressing the City of El Segundo’s pension
liabilities in order to achieve financial stability.
While proud of his past successes, Mitnick
did not shy away from owning up to a few
failures. For instance, he admitted to being
“impatient at times” with “too high expectations”
during his stint at Sutter County. At
Thousand Oaks, he was disappointed in not
being able to convince the city council to place
a revenue measure on the ballot to allow local
residents to vote on providing the community
with long-term financial security -- and he
said he may have “worked too hard and was
too driven.” However, Mitnick views these as
useful learning experiences that will only help
in his future endeavors in El Segundo.
One publicized past mistake led to Mitnick’s
dismissal from his position in Thousand Oaks
in 2017 despite 11 consecutive years of strong
annual performance reviews. In 2016, he
used his city email account to help his son’s
high school baseball booster club contact
and attempt to secure donations. El Segundo
Mayor Drew Boyles alluded to the incident
when announcing during last month’s strategic
planning session that he and his colleagues had
unanimously agreed on a new city manager.
He warned those in attendance that they might
read about or hear a few things, but that the
Council did extensive due diligence and had zero
concerns whatsoever about their selection. “This
happened over three years ago and I prefer to
leave it in the past,” Mitnick said about his
departure from Thousand Oaks. “I am proud
of the nearly 17 years of success in Thousand
Oaks from 2000 to 2017. What happened was
politically driven and the action taken by the
city council was overly harsh and unnecessary.
However, I accept full responsibility for
my actions and blame no one else but myself
for allowing the roles of father and city manager
to overlap. Today I am a much better person,
husband, father and city manager as a result.”
As for the husband and father roles, Mitnick
met his wife right after high school and the
two have now been married for 30 years. They
have twin boys who are 18 years old and both
college sophomores.
When not in the office, one of Mitnick’s
favorite hobbies is building LEGO® projects
after hours and during the weekends. Then
again, he doesn’t venture all that far from his
day job since his preferred theme is the “city”
series. “I have a LEGO® city hall on my desk
that I built several years ago,” he said.
Whether it’s a LEGO® set or an entire city,
Mitnick emphasized that the end goal is the
same – starting out with the basic building
blocks and putting together something special
with lasting appeal. With that in mind, he said
he hopes that El Segundo will be his crowning
achievement. And if necessary, he will stock
up on those Hawaiian shirts… •

The Ordinance establishes permitting
and regulatory program for commercial
and multi-family residential properties,
and specific State requirements related
to three solid waste sub-programs:
Residential Solid Waste Collections (by
Exclusive Franchise), Commercial and
Multi-Family Solid Waste Collections
(New City Permit Program), and Organics
(AB1826).
