ENVIRONMENTAL REVIEW: Pursuant
to State CEQA Guidelines Section 15061
(b) (3) (general rule), which exempts actions
when it can be seen with certainty
that there is no possibility of a significant
effect on the environment. The Zone
Amendment would amend the Municipal Code
to define Short Term Rentals (STR) within the
City and provide regulations for the establishment
of the use. The amendment will further
clarify the types of structures permitted to be
utilized as STRs. The amendment consists of
the operation, licensing, and leasing of existing
private structures involving negligible or no
expansion of the use beyond that existing at
the time of the determination as described in
State CEQA Guidelines Section 15301 (Class
1). The ordinance is therefore exempt
from the provisions of CEQA.
PLEASE NOTE that pursuant to Government
Code Section 65009: In an action or
proceeding to attack, review, set aside, void,
or annul a finding, determination or decision
of the Planning Commission or City Council,
the issues raised shall be limited to those
raised at the public hearing in this notice or
in written correspondence delivered to the
Planning Commission or City Council at or
prior to the public hearing.
