PIPELINE FRANCHISE FROM
EXXONMOBIL OIL CORPORATION TO
TORRANCE VALLEY PIPELINE COMPANY,

COMPANY, LLC.
NOTICE IS HEREBY GIVEN that on Tuesday,
October 10, 2017, at 6:00 P.M., a Public Hearing
will be held in the City Council Chambers,
4455 West 126th Street, Hawthorne, California,
90250 to consider all protests or objections to
the following proposed Ordinance No. 2131:
“An Ordinance of the City Council of the City of
Hawthorne, California, Transferring a Petroleum
Franchise from ExxonMobil Oil Corporation to
Torrance Valley Pipeline Company, LLC and
Torrance Pipeline Company, LLC and Exercising
Certain Rights of the City with Respect to
the Rate of Fees Due under that Franchise.
All Interested Persons are hereby invited to
attend a public hearing at which all persons
interested in or objecting to the proposed
transfer of the pipeline franchise may appear
and be heard. If you wish to legally challenge
any action taken by the City on the above
matter, you may be limited to raising only
those issues you or someone else raised at
the public hearing described in this notice, or
in written correspondence delivered to the City
prior to or at the public hearing.
The grantee of the pipeline franchise and its
successors and assigns will, during the life of its
franchise, pay to the City of Hawthorne for the
pipeline area occupied by each pipeline it installs
or operates under this extended franchise at an
annual rate of $1.01 base rate per linear foot
for an 8” pipe and $3.64 base rate per linear
foot for a 16” base rate per linear foot. The
base franchise fee shall be due and payable
during the life of the franchise.
Base Franchise Fee.
1. A base franchise fee shall be paid by the
Grantee to the City for the pipeline area occupied
by each pipeline it installs or operates under
this extended franchise at an annual rate of
$1.68 per cubic foot. Equivalent fee converted
to linear feet can be found in the table below.

increase shall be computed pursuant to the
Producer Price Index for all commodities in
the following manner: Effective upon approval
of this Ordinance, the base CPI for computing
the adjustment is the Consumer Price Index,
all Urban Consumers for the Los Angeles-
Anaheim-Riverside Area (1982-84 = 100)
The base franchise fee shall be due and payable
during the life of the franchise, including the
year of granting the franchise. For purposes of
this subsection, the pipeline area occupied by
a pipeline, pipe connections, cathodic protection
facilities, pipe casings and other minor
appurtenances shall be taken as equivalent
to the volume occupied by a cylinder of equal
length having a diameter of one (1) inch (for
metal pipe) or two (2) inches (for plastic pipe)
greater than the nominal internal diameter of
the pipe or conduit but in no case with an
equivalent cylinder diameter less than four (4)
inches, and the payment rate therefore shall
be computed to the nearest tenth of a cent
per lineal foot of pipe. Pipeline area occupied
by any appurtenances such as manholes or
vaults shall be computed from the outside
dimensions of the structure. The annual fee
shall be paid no later than December 31 of
each calendar year.
The compensation provided for in Section 3B
shall be subject to an increase after the first
year of the anniversary date of the Franchise
and each subsequent year thereafter during
the term of this Franchise. The amount of
period of April 2016 (hereinafter referred to as
the “Beginning Index”0. If the index published
for the year proceeding Payment due date
(hereinafter referred to as the “Extension Index”)
has increased over the Beginning Index, the
Franchise fee for the following year (until the
next adjustment) shall be set by multiplying
the Franchise fee set forth in Section 3B
by a fraction, the numerator of which is the
Extension Index and the denominator of which
is the Beginning Index. In no case shall this
increased compensation be less than the
Franchise fees set forth in Section 3B. If the
Index is discontinued or revised during the terms,
such other mutually agreeable governmental
index or computation with which it is replaced
shall be used in order to obtain substantially
the same results that would be obtained if the
index had not been discontinued or revised.
