goes into effect retroactively to give exiled
tenants the ability to fight in court with their
landlord. Hensley opined that this probably
wouldn’t be enforceable and that “for those
who left, this [clause] will not provide any
remedy because they’re gone.”
Councilmember Chris Pimentel did not
like the idea of the City intervening to take
money out of landlords’ pockets. Nicol
stressed that the “state put a gun to the head”
of landlords by essentially telling them to
“either be a bad person and evict all your
tenants” or be willing to chop potential
value from their properties. Mayor Drew
Boyles saw the initial motion as a way
to “help some people in the community.”
Pimentel offered the idea of “a month or two
months’ rent” that doesn’t penalize property
owners -- while still providing a mechanism
to help renters through a housing transition.
The revised motion was enough to capture
the required four votes to pass the urgency
ordinance. Hensley confirmed that the onemonth
rent subsidy also complies with the
state’s requirements. He added that some
people may still be living in their units
despite eviction notices that go back many
months, as they may be battling with their
landlords over items that have nothing to do
with AB1482. •
