in the 1990s, but did not have the educational
background in the industry.
“It is very rare,” he said, “to have a private
banker without a formal education…most
of them have MBA’s” or other impressive
letters of the alphabet embossed on their
business cards.
Jim was born in Oswego, New York, and
spent his youth moving about the East-Coast
with his family. His Dad was “good at
fixing-up retail stores,” so the family moved
around quite a bit following his father’s work
opportunities.
Now that he is firmly ensconced in relatively
compact El Segundo, like many residents, he
cherishes the fact that his kids could walk
to school and walk to the local ballfield. He
also noted the strong parental involvement
in local activities as a selling point for the
town. And, as a triathlete, the proximity to
the Pacific Ocean doesn’t hurt.
Fenton competed in his first triathlon in
2017. He went down that path because he
had broken his foot while running at the high
school track, so to get exercise, he took to
riding his bike and swimming at the Plunge.
When he told his wife he was training to
participate in a “Half Ironman” competition,
she apparently quipped, “half Ironman?
Sounds like half-a-man,” wife Donna said.
So, Fenton decided to use that comment to
motivate him to train to participate in a full
Ironman competition, which he did for the
first time in 2018, in Madison, Wisconsin.
Brother Sean Fenton, the oldest of six
siblings, related how Jim has served as an
inspiration to him; a couple of years ago, when
Jim announced that he was going to participate
in the Madison Ironman competition, Sean
said he made plans to travel from his North
Carolina home to Wisconsin to support his
brothers blossoming athletic endeavors.
“It was a spectacular experience that I
had with my brother,” Sean said. Sean said
he was a bit leery when Jim announced
his Ironman participation plans. “I was so
astounded,” Sean related, who admitted that
he didn’t have a clue to what the Ironman
competition entailed. “There was no way
that I was going to miss this.”
After watching Jim complete the grueling
Ironman competition, Sean said he was so
overwhelmed and inspired that he decided to
begin training to compete in Ironman festivities
and hopes to join Jim this December at the
La Quinta, California competition, dubbed
the “70.3” because the miles traversed are
one-half of the miles Ironman’s 140+ miles
that participants endure.
Of course, currently, a COVID effect question
must be asked. Fenton said he tested
positive for COVID but was fortunate only
to have what he termed “mild symptoms” for
two weeks. He said that the biggest impact on
the Fenton’s of the virus was that youngest
son Jack; currently, a freshman at El Segundo
High School has not been able to attend
class in person, calling remote learning “very
challenging.” Jim Fenton noted the expanded
screen-time currently facing students, with the
subsequent extreme diminishment of social
interaction for students. “As an incoming
freshman,” Fenton said, “he misses that
experience of being in high school with his
friends. We are proponents of getting the kids
back in the classroom as much as possible
when the state guidelines are met. Let’s go!”
he said, about the return to the classrooms.
So now you know a little about Jim Fenton
and family: Relocating from North Carolina,
the state made famous by the fictional town of
Mayberry, to the town many refer to as the West
Coast Mayberry by the sea. North Carolina’s
loss has turned out to be El Segundo’s gain. •

DETAILED SUMMARY OF MATTER TO BE
VALIDATED:
The City provides its employees with
retirement benefits under the requirements
of the Public Employees Retirement Law,
California Government Code section 20000
et seq. (Retirement Law), pursuant to a
contract, as amended from time to time, it
has entered into with the California Public
Employees Retirement System (CalPERS,
and the CalPERS Contract). The City
has established three pension plans for
its employees, a Miscellaneous Plan (the
“Miscellaneous Plan”), a Safety Police First
Tier Plan (the “Policy First Tier Plan”), and a
Safety Fire Plan (the “Fire Plan”) pursuant to
the CalPERS Contract. The Retirement Law
obligates the City, among other things, to: (1)
make annual contributions to CalPERS to
fund pension and other retirement benefits
for its members and their beneficiaries; (2)
amortize the unfunded accrued actuarial
liability of the City under the Retirement Law,
which is the liability for retirement benefits
that has accrued under the Retirement Law
and the CalPERS Contract but which the
City has not yet paid to CalPERS; and (3)
appropriate funds to pay these obligations.
As of June 30, 2019, based upon the
actuarial reports of pension liability as
calculated by CalPERS with respect to
the Miscellaneous Plan, the Police First
Tier Plan, and the Fire Plan (together,
the “Actuarial Reports”), the City had an
aggregate obligation for its Unfunded
Accrued Actuarial Liability in the amount
of amount of $151,299,753 (consisting of
$34,576,384 for the Miscellaneous Plan,
$61,384,985 for the Police First Tier Plan,
and $55,338,384 for the Fire Plan) pursuant
to the Retirement Law, based on the market
value of assets. The City understands and
believes that, in the current market, it can
issue taxable bonds at a true interest cost
not more than 4.00% (current expected true
interest cost estimated at 2.73%). Thus, the
City can realize a substantial savings on its
interest expense by issuing the Bonds, using
the proceeds to refund its Unfunded Accrued
Actuarial Liability under the CalPERS
Contract, and thereby pay a lower interest
rate on the Bonds than the rate it would
otherwise have to pay to CalPERS.
On January 19, 2021, after public notice
in accordance with law, the City Council
adopted the Resolution (Resolution No.
5246), entitled, “Resolution Of The City Of
El Segundo, California Providing For The
Issuance Of One Or More Series Of City
Of El Segundo Taxable Pension Obligation
Bonds And Authorizing A Trust Agreement, A
Validation Action And Other Matters Relating
Thereto” (Resolution). A true and correct
copy of the Resolution is attached to the
complaint. Summarized, in the Resolution
the City Council authorized, among other
things, the issuance of one or more series
of pension obligation bonds, and the
execution and delivery of a trust agreement
and supplemental trust agreements in
connection with the issuance of such bonds,
to facilitate the payment of all or a portion of
the City’s unfunded accrued actuarial liability
and, to the extent consistent with the City’s
then-existing local debt policy, the City’s
annual contributions to CalPERS, to fund
pension benefits for its members and their
beneficiaries.
The City brought this validation action to
confirm the validity of this bond transaction
and its terms, as described above and more
specifically in the complaint. The City seeks
an order declaring, among other things,
that the City’s incurrence of any and all
indebtedness and/or liability in connection
with the pension obligation bonds, the City’s
unfunded accrued actuarial liability, and
any annual contribution to CalPERS, as
authorized in the Resolution and pursuant
to the CalPERS Contract, is subject to an
exception, and not otherwise subject, to the
debt limitation set forth in Article XVI, Section
18 of the California Constitution. The Plaintiff
has filed a civil complaint against you. If you
wish to contest the legality or validity of the
matter that is the subject of this lawsuit, you
must appear and file with the Court a written
pleading in response to the Complaint not
later than March 22, 2021. Your pleading
must be in the form required by the California
Rules of Court. Your original pleading must
be filed in this Court with proper filing fees
and proof that a copy thereof was served on
Plaintiff’s attorneys.
Unless you so respond, your default will be
entered upon Plaintiff’s application, and this
Court may enter a judgment against you
for the relief demanded in the complaint.
Persons who contest the legality or validity
of the matters which are the subject of this
lawsuit will not be subject to punitive action,
such as wage garnishment or seizure of their
real or personal property.

The City of El Segundo is accepting the
submittal of sealed proposals to City Hall,
350 Main Street, El Segundo, California
90245, until 4:00 p.m. on:
TUESDAY, APRIL 27, 2021
Proposals will not be accepted after that
time.
As described in the RFP Documents, the
proposals are for engineering and design
services for a public works project (“Project”)
which consists of final roadway, railroad,
two railroad bridges, and environmental
remediation design plans and specifications
for the Park Place Extension Project
between Nash Street and Allied Way in the
City of El Segundo.

list. The top rated consultants may be
requested to interview with several members
of City staff, who will make the final selection
for recommendation to the City Council. Oral
interviews, if held, will be scheduled in June
2021.
