FEES PURSUANT TO HAWTHORNE
MUNICIPAL CODE CHAPTER 8.20 AND
BUILDING DEPARTMENT FEES
PURSUANT TO CHAPTER 15.
NOTICE IS HEREBY GIVEN that on Tuesday,
November 26, 2019, at 6:00 P.M., a Public Hearing
will be held in the City Council Chambers,
4455 West 126th Street, Hawthorne, California,
90250 to consider all protests or objections to a
fee to cover the actual costs of administering and
enforcing Chapters 8.20 (Public Nuisances) and
Chapter 15 (Building Code) of the Hawthorne
Municipal Code.
If you challenge the subject matter of this public
hearing in court, you may be limited to raising
only those issues you or someone else raised
at the public hearing described in this notice,
or in written correspondence delivered to the
City Council at, or prior to, the public hearing.
An annual adjustment shall occur for all fees
identified in this public hearing notice. Such
adjustment shall occur by using the California
Per Capita Personal Income Index as reported
quarterly by the State Department of Finance.
Said adjustment shall be effected on July 1st
of each calendar year based upon the actual
percentage change for the latest reported four
quarter period. Increases or decreases shall be
rounded off to the nearest dollar. In no event
shall the fee collected exceed the actual cost
of providing the service by the City.
The amount of the adjustment shall be approved
by the City Manager and shall provide such
adjusted figures annually.
A written report has been prepared and filed

fee equals the estimated reasonable cost
of providing the service for which the fee is

Summary of Adoption of Ordinance 2192
Amending Chapter 8.20 of Title 8 of the
Hawthorne Municipal Code (“HMC”) Adding
Specified Conditions Accompanied by
Prolonged Vacancies in a Residential or
Commercial Building Constitutes a Condition
of Public Nuisance, Related Changes
to Definitions and Enforcement
Pursuant to Government Code section
36933(c), the following constitutes a summary
of Ordinance No. 2192 which was adopted
by the City Council at its regular meeting on
November 12, 2019 at 6:00 p.m. Pursuant to
California Government Code section 36933(c)
(1), the City Council has previously directed the
preparation and publication of a summary of
Ordinance No. 2192 which adds that specified
conditions accompanied by prolonged vacancies
in a residential or commercial buildings will
constitute a public nuisance.
Ordinance No. 2192 adds a new section
8.20.030(A)(36) providing that specified
conditions, e.g., dilapidated buildings, overgrown
vegetation, graffiti, etc., accompanied
by prolonged vacancies of ninety or more
consecutive days constitutes a public nuisance.
It also makes related changes to the definitions
and enforcement.
Under section 8.20.030(A)(36), the specified
conditions to deem a prolonged vacant
residential or commercial building a public
nuisance are when there exist two of the
following conditions (summarized):
a. Property which is not kept substantially clean
and free from accumulations like overgrown,
dead or decayed trees or vegetation, or trash.
b. Buildings or structures which are unpainted
or the exterior paint is worn off.
c. Buildings or structures or its sections, e.g.,
exterior stairs, roofs, foundations, walls, fences,
etc., which are substantially broken, deteriorated,
or defaced with graffiti, or windows which are
missing or broken.
d. In a residential property, outdoor display
of unused appliances, furniture and other items
other than those commonly stored outdoors,
for a period of time in excess of seventy-two
consecutive hours.
e. Where property is vacant and otherwise
required to be boarded up, the boarding shall
be done in a manner approved by the building
official and which does not itself have a significant
adverse visual impact on the neighborhood nor
substantially contribute to the dilapidated or
deteriorated appearance of the neighborhood.
f. Buildings designed for human use or occupancy
that stays vacant for more than ninety
consecutive days unless the City Manager
finds the following:
• It is offered for sale, lease or rent.
• It is in the process of repair that is progressing
diligently.
• It is actively maintained and monitored by
the owner and thus not contribute to blight.
The above (a) through (e) describes conditions
visible from a public right of way and/or
neighboring property that have a significant
adverse visual impact on the neighborhood.
Ordinance No. 2192 also amends section
8.20.020 “Definitions” by adding/revising the
following subsections (summarized):
(L) Commercial buildings/structure/property
shall mean any commercial, industrial structures
affixed to or upon real property used for the
purpose of conducting a business.
(EE) Real Property or premises shall mean
all residential, industrial, commercial, and other
real property including, but not limited to, vacant
lots, front yards, side yards, back yards,
driveways, walkways, alleys and sidewalks,
and any building or other structure whether
fixed or movable, located on such property.
(FF) Residential building/structure/property
shall mean any structure including, but not
limited to, any house, garage, duplex, apartment,
condominium, stock cooperative, mobile
home, or other residential structure, whether
or not such structure is occupied.
Section 8.20.030 (D) also amends by referencing
marijuana related uses as currently defined in
the Zoning Code thus maintaining consistency
with the two Titles.
Ordinance No. 2192 adds the following provisions
related to enforcement:
• Section 8.20.280, “No duty to enforce”, provides
that the City is under no duty to enforce any
provisions of the Chapter.
•Section 8.20.290, “Violations-penalties and
remedies” provides that the violations of the
Chapter can be prosecuted as misdemeanors
and that a separate offense occurs each and
every day. Subsections “D” authorizes the City
Attorney to bring an action for injunctive relief.
Subsection “E” allows enforcement through the
issuance of administrative citations.
• Section 8.20.300 provides for the City to seek
inspection warrant where the owner does not
give consent for inspection.
• Section 8.20.310 provides that the City may
establish fees for the inspection of properties
found to be in violation of the ordinance.
This proposed ordinance is exempt
from CEQA review pursuant to State
CEQA Guidelines, Article 18: Statutory
Exemptions, Section 15282(h) because
this section of CEQA establishes a statutory
exemption for “the adoption of an
ordinance regarding second units in a
single-family or multifamily residential
zone by a city or county to implement
the provisions of Sections 65852.1 and
65852.2 of Government Code as set
forth in Section 21080.17 of the Public
Resources Code.
A certified copy of the entirety of the text of
Ordinance No. 2192 was and is available
both on the City’s website and also in the office
of the City Clerk, 4455 West 126th Street,
Hawthorne, California, and is open for public
inspection. Pursuant to Government Code
section 36933(c), the summary Ordinance No.
2183 was published at least five (5) days before
the ordinance was considered for adoption
on November 12, 2019 at a duly convened
regular meeting of the Hawthorne City Council.
