Under CEQA
Pursuant to Government Code section 36933(c),
the following constitutes a summary of Ordinance
No. 2226 which will be considered for adoption
by the City Council at its regular meeting on
November 9, 2021 at 6:00 p.m. Pursuant to
California Government Code section 36933(c)
(1), the City Council has previously directed the
preparation and publication of a summary of
Ordinance No. 2226 which is required under
SB 1383 establishing methane emissions
reduction targets.
Ordinance No. 2226 is amendment of several
ordinances and policies to facilitate compliance
with SB 1383, including, but not limited to, a
mandatory organics service ordinance, an
enforcement ordinance, a CALGreen C&D
ordinance, a Model Water Efficient Landscaping
Ordinance (MWELO), and procurement policies
aligned with the state’s Public Resources Code.
SUMMARY MUNICIPAL CODE CHANGES:
The following is a summary of the updates made
to the City’s Municipal Code for compliance with
the legislation and other City policy decisions.
• Enforcement of the Code has been reviewed
for compliance with SB 1383 and did not
require updates.
• Recyclable Materials, Organic Materials,
and Solid Waste Collection and Disposal
modifications:
• Definitions have been added and updated
to align with SB 1383.
• Sections were inserted to aid organization
of the Chapters.
• Includes requirements for the City’s franchise
hauler and limitations for self-haul/back-haulers.
• Prohibits generators from placing incorrect
materials in containers, such as organic materials
in the recycling container.
• Includes the requirements for single family,
multi-family, and commercial businesses as
separate sections.
• Adds the requirements for issuance and
approval of allowable waivers from collection
service under SB 1383. Allows City, with proper
documentation, to automatically issue waivers.
• Updates enclosure space requirements to
include space for an organics, recycling, and
solid waste container.
• Gives the City authority to inspect and
investigate complaints or confirm compliance
for SB 1383.
• Includes provisions that City cannot take
enforcement action before required date in SB
1383 (January 1, 2024).
• Adds the edible food recovery requirements
for commercial edible food generators
to comply with the requirements including
arranging for edible food donation services,
record keeping, etc.
• Adds requirements for food recovery
organizations to comply with the requirements
including implementation of written agreements,
record keeping, reporting, etc.
• The Landscape Water Efficiency chapter has
been reviewed for compliance with SB 1383
and required minor updates.
• Building Standards Codes and Administrative
Provisions Pertaining to Building and Construction
has been reviewed for compliance with SB
1383 and required minor updates.
• Sample language was provided to align
with the procurement requirements for internal
administrative policy update and is not required
to be included in the Municipal Code.
• Other Notable Revisions/Updates:
• Clarifies the responsible party for participation
or subscription to collection service that was
ambiguous in prior legislation.
The City Council finds and determines that
there is no possibility that the adoption of this
Ordinance will have a significant effect on the
environment. Accordingly, this Ordinance is not
subject to the requirements of the California
Environmental Quality Act (CEQA) pursuant to
Sections 15061(b)(3) and 15378 of Division 6
of Title 14 of the California Code of Regulations
A certified copy of the entirety of the text of
Ordinance No. 2226 is available both on the
City’s website and also in the office of the City
Clerk, 4455 West 126th Street, Hawthorne,
California, and is open for public inspection.
Pursuant to Government Code section
36933(c), the summary Ordinance No. 2226
was published at least five (5) days before
the ordinance was considered for adoption
on October 26, 2021 at a duly convened
regular meeting of the Hawthorne City Council.

Project Location: City-wide
Project Description: This project is a Cityinitiated
amendment to Title 17 (Zoning)
addressing mixed-use standards and guidelines,
as contained in Chapter 17.29 Mixed
Commercial Classification), 17.87 (Mixed
Use Overlay Zone) and Appendix B in the
Hawthorne Municipal Code.
Pursuant to Executive Order N-25-20 and
N-29-20 members of the City Council and staff
may participate in this meeting via video-link
(Zoom) and or teleconference. In the interest
of maintaining appropriate social distancing
and to protect the health and safety of the
Council, staff and public from exposure to
COVID-19, this will not be an in-person meeting
and the Council Chambers will not be open
for this meeting. Members of the public
are encouraged to make comments by

PURSUANT TO the California Environmental
Quality Act (CEQA) Guidelines
Section 15061(b)(3) of Title 14 of the California
Code of Regulations, staff has determined
that it can be seen with certainty that there
is no possibility that the adoption would have
and significant effect on the environment as
there is no change in use, density or intensity
of uses, nor would amendment of Chapter
17.87 and Appendix B result in direct physical
development of the project areas. In addition,
future development within the project area was
anticipated and evaluated within the scope and
analysis of the Draft Environmental Impact
Report for the Mixed Use Overlay Zone and
R-4 (Maximum Density) Zone project, certified
by the City Council on May 24, 2011 (SCH
#2009061099), for changes to Chapter 17.87
and accompanying Appendix B.

Code Section 65009: In an action or
proceeding to attack, review, set aside, void,
or annul a finding, determination or decision
of the Planning Commission or City Council,
