Summary of Ordinance 2157
On May 8, 2018 at 6:00 p.m., the City Council
of the City of Hawthorne adopted Ordinance
No. 2157, a proposed ordinance amending Title
17 (Zoning) by Adding a New Chapter 17.22C
(Airport Overlay Zone) to Title 17 (Zoning) of the
Hawthorne Municipal Code to Implement the
Noise Compatibility Program for the Hawthorne
Municipal Airport and Amending the City’s
Zoning Map to Establish the Boundaries of
the Airport Overlay Zone.
Pursuant to California Government Code section
36933(c)(1), the City Council has directed the
preparation and publication of a summary of
Ordinance No. 2157 as follows:
Ordinance No. 2157 would amend the City’s
zoning map to establish the boundaries of the
Airport Overlay Zone (“AOZ”). The AOZ would
be divided into two areas as follows: (a) AOZ
Area #1 (AOZ #1) follows the property borders
that contain the boundaries of the 2012 65
CNEL noise contours for the Airport, and (b)
AOZ Area #2 (AOZ #2) roughly follows the
property borders that contain the boundaries of
the 2012 60 CNEL noise contours for the Airport.
Ordinance No. 2157 would also add Chapter
17.22C, Airport Overlay Zone (AOZ), to add
use and development standards for the
noise-sensitive uses within each of the two
areas within the AOZ. The main provisions
of the proposed Chapter pertaining to AOZ
Area #1 include:
• Require any structure that is used by
a noise-sensitive use to provide sound insulation
within a newly constructed area to meet
an interior noise level of 45 dB CNEL. This
provision would apply to any new structure,
new square footage/addition, and replacement
of existing habitable building area used by a
noise-sensitive use.
• Clarify that the disclosure of the potential
impacts of the Airport is required during all real
property transactions per the State of California
Disclosure Law (California Civil Code Sections
1353(a)(1) and 1103.4).
• Prohibit new noise-sensitive land uses
from being introduced within AOZ Area #1. This
applies to the introduction of new land uses other
than an existing land use and does not apply to
the replacement, reconstruction, improvement, or
expansion of an existing noise-sensitive land use.
The main provisions of the proposed Chapter
pertaining to AOZ Area #1 include:
• Clarify that the disclosure of the potential
impacts of the Airport is required during all real
property transactions per the State of California
Disclosure Law (California Civil Code Sections
1353(a)(1) and 1103.4).
In addition, Ordinance No. 2157 makes editorial
amendments to Section 17.10.010 to incorporate
the AOZ zone, list the RPZ (“Runway Protection
Zone”) Overlay in the table, and make minor
format changes to the zoning summary table.
A certified copy of the entirety of the text
of Ordinance No 2157, together with the
Codes to be adopted thereby, is available in
the office of the City Clerk, 4455 West 126th
