AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF HAWTHORNE,
CALIFORNIA, AMENDING HAWTHORNE
MUNICIPAL CODE, TITLE 2
[ADMINISTRATION, CIVIL SERVICE &
PERSONNEL], CHAPTER 2.22 [PARK,

2.22.130 J [SIDEWALK OR ROAMING
VENDORS IN CITY PARKS].
WHEREAS, Senate Bill “SB” 946, informally
known as the “Safe Sidewalk Vending Act,”
became effective January 1, 2019; and
WHEREAS, before SB 946 became effective,
cities and counties enjoyed broad authority to
regulate sidewalk vendors. Indeed, many
jurisdictions, such as the City of Hawthorne
prohibited sidewalk vendors; and
WHEREAS, the new law defines “sidewalk
vendors” to include any person who sells food
or merchandise from a pushcart, wagon, or
other non-motorized conveyance, or from his
or her person, while on a public sidewalk or
other pedestrian path. A sidewalk vendor may
be “stationary” or “roaming;” and
WHEREAS, SB 946 precludes cities from
prohibiting sidewalk vendors in public parks.
A limited exception is allowed where a concessionaire
has been granted an exclusive
concession for the sale of food or merchandise.
In such case, a local authority can prohibit
stationary sidewalk vendors but must allow
roaming sidewalk vendors; and
WHEREAS, Section 2.22.130 J is being
amended in order to conform to the new
requirements imposed by SB 946.
The City Council of the City of Hawthorne,
California, does hereby ordain as follows:
SECTION 1. Section 2.22.130 J is hereby
amended as follows:
Unlawful conduct
It is unlawful for any person within any public
park, except as provided in Section 2.22.140, to:
Sell or offer for sale any merchandise, article
or thing whatsoever without special written
permit from the director of parks and recreation
first obtaining a business license and permit
pursuant to Chapter 5.57A of the Hawthorne
Municipal Code.
SECTION 2. If any provision, clause, sentence
or paragraph of this Ordinance or the application
thereof to any person or circumstance shall be
held invalid, such invalidity shall not affect the
other provisions of this Ordinance which can
be given effect without the invalid provisions
or application, and to this end the provision of
this Ordinance are declared to be severable.
SECTION 3. The City Clerk shall certify to the
passage and adoption of this Ordinance and
shall cause the same to be published once in
a newspaper of general circulation, published
and circulated in the City of Hawthorne, or if
there is none, she shall cause it to be posted
in at least three public places in the City of
Hawthorne, California.

Council shall nominate a Mayor Pro Tem, and

Summary of Adoption of Ordinance 2176
Adding Section 12.04.031 to Chapter
12.04 (Sidewalk & Curb Repair) to the
Hawthorne Municipal Code (“HMC”).
Pursuant to Government Code section 36933(c),
the following constitutes a summary of Ordinance
No. 2176 which will be considered for adoption
by the City Council at its regular meeting on
March 12, 2019 at 6:00 p.m. Pursuant to
California Government Code section 36933(c)
(1), the City Council has previously directed the
preparation and publication of a summary of
Ordinance Nos. 2176 which expressly imposes
the legal obligation for sidewalk repair on adjacent
property owners, as follows:
Streets and Highway Code §5610 requires that
the owners of property fronting a public street
or sidewalk shall maintain any sidewalk in such
a condition that it will not endanger persons
or property and that the property owner will
maintain it in a condition that will not interfere
with the public convenience. Property owners
will not be liable for damages or injuries
unless the municipality enacts an ordinance
that addresses liability. Ordinance No. 2176
will establish property owner liability for adjacent
public sidewalks, parkways, lawn strips, driveway
aprons, curbs and gutters. In addition, Ordinance
No. 2176 will result in the efficient identification
and repair of public sidewalks, decrease the
burden and the expense on the City to identify
and effectuate repairs and to more effectively
defend against litigation arising out of alleged
sidewalk defects.

Each bid shall state the unit price of each

Bids will be opened in public in the City

Specifications and other bid documents for
the project are on file in the Public Works
Department, and may be obtained upon
payment of $50 for one set of copies and
$15 for each CD copy.
Each bid must be accompanied by a deposit in
the form of cash, a cashier’s or certified check

bid bond, for an amount of not less than ten
percent (10%) of the aggregate of the bid. This
is a guarantee that the successful bidder will,

amount of the contract sum, and another for

The City Council reserves the right to reject
any or all bids and to waive any irregularities

for a period not to exceed sixty (60) calendar
days from and after the date bids are opened

provisions of Labor Code § 1725.5: No contractor
or subcontractor may be listed on a bid
proposal for a public works project (submitted
on or after March 1, 2015) unless registered
with the Department of Industrial Relations
(with limited exceptions for this requirement for

1771.1a). No contractor or subcontractor may
be awarded a contract for public work on a
public works project (awarded on or after April
1, 2015) unless registered with the Department
of Industrial Relations. All contractors and

all new projects awarded on or after April 1,
2015. The Labor Commissioner may excuse
contractors and subcontractors on a project

programs (Caltrans, City of Los Angeles, Los

Sacramento) or that is covered by a qualified
project labor agreement. This project is subject
to compliance monitoring and enforcement by
the Department of Industrial Relations.
