Of the 292 people hurt, 15 were hospitalized
and two were seen in the emergency room.
Researchers said they excluded 74 emergency
room visits from the results since they couldn’t
be certain the patient was aboard a scooter
at the time of the accident.
The popular scooters have a top speed of 15
mph. Bird and Lime recommend that riders
be at least 18 years old and wear helmets, but
it’s optional for adults. A new California law
for 2019 eliminated the helmet requirement
for e-scooter riders 18 and older.
To reduce the dangers of pedestrians tripping
over parked scooters, Santa Monica has
installed dockless e-scooter and bike zones on
city streets as a way to balance public safety
and ease-of-use for residents and visitors.
Lawyers say winning damages in personal
injury cases against scooter operators isn’t
simple. Pedestrians who claim they were
injured dodging a scooter on the sidewalk
typically have no one to sue because the riders
are long gone. Riders hit by cars probably
have the strongest cases.
“I have been turning away a lot of callers
because I need to have an insurance company
to go after,” says Catherine Lerer, whose
firm is representing the injured pedestrians in
the class-action suit. Expect the number of
accidents on college campuses and heavily
touristed precincts to increase, she said last
June when the pay-by-the-minute transportation
option first showed up. Bird and Lime
have pushed back against municipal bans,
including one quickly approved last year for
Beverly Hills. The dockless vehicles got a
reputation as a public nuisance because they
were dropped on sidewalks and street corners
where pedestrians were forced to walk around
or step over them. •
