The most lenient option was to waive or reduce the fee with the argument that the museum is singularly unique and provides a major community benefit. Staff recommended a middle ground approach to amend the Downtown Specific Plan to remove the requirement for a recorded parking covenant for “non-profit museums of art” and instead provide an agreement subject to review and approval by the City (which would also be a third party beneficiary). The City would also be notified of any changes to the agreement or property ownership. Boyles thought the move was unnecessarily complicated and wondered “why we can’t have a variance” for ESMoA. As she did in September, Mayor Fuentes expressed her disdain for “spot zoning” that favors one business and she thought it sets a bad precedent. While not wishing to punish the museum, Dugan also was averse to changing City codes. In the end, the Council majority opted to exclude ESMoA from the in-lieu parking requirement. The Council authorized the City Manager to enter into an agreement regarding funding sources for the future El Segundo Aquatics Center on Wiseburn Unified School District property. Of the $13.8 million estimated project cost, $6 million will come from Wiseburn; another $6 million from South Bay Sports, Health and Recreation (a nonprofit set up by Continental Development Corporation President Richard Lundquist); and $1.8 million from the City’s aquatics fund. The City already contributed $300,000 for design, leaving $1.5 million. With this agreement, the City will provide $750,000 within 30 days of the construction bid award and the balance 90 days after. If bids go over, the three parties will discuss contingencies—though the City won’t have any additional funding obligations over the $1.8 million total. The City Attorney said more information on the bid amount will be available around December 8. He added that while the project could initially fall within budget, eventual change orders might put it over the top. In that case, the parties would go over alternate funding options or reduce the project scope. If the project ends under budget, the excess monies under the $13.8 million go back to the non-profit. According to Hensley, Lundquist plans a separate campaign to raise dollars to renovate The Plunge. Chief Tavera invited citizens to attend a meeting (that will also be videotaped) at City Hall on November 21 at 7 p.m. to address the continuing coyote problem in town. Another meeting at the same location on November 29 at 6 p.m. will discuss oversized vehicle parking. Tavera also reported that a diver lost his life this week when caught in the pipes at the NRG facility. Under the state law, local jurisdictions are permitted to make amendments to the State Code if there are local conditions that make it reasonably necessary because of local climatic, geological or topographical conditions. Both the Building Safety Division and the Fire Department staff are proposing amendments to the California Building, Residential, Plumbing, Mechanical and Fire Codes. The amendments will affect construction of new buildings and additions to existing buildings and are not retroactive to existing buildings. Staff is recommending amendments to the Building, Residential, Plumbing, Mechanical, Existing Building, California Green Building Standards, Uniform Housing, International Property Maintenance, International Swimming Pool and Spa, Abatement of Dangerous Building, and Fire codes be adopted to protect the welfare of the occupants and to ensure the economic viability of the community. The Building Safety Division also took this opportunity to renumber the Chapters of Title 13 to be more aligned with the CCR Title 24 State model code for ease of use. The Residential Noise Insulation Standards section is relocated to corresponding sections in the CRC and the CBC.
