committing burglaries, mail theft, etc.,” the
chief said. According to Whalen, the stay-athome
orders since March 2020 created the
environment that led to El Segundo’s spike
in car break-ins and thefts.
According to the crime data, opportunistic
thieves swiped 154 vehicles from El Segundo
streets and parking lots, 80 more than the year
before. ESPD has assigned an investigator to
a Los Angeles Auto Theft task force, which is
studying the types of vehicles stolen and their
locations to identify patterns in the auto-crime
wave across the South Bay and countywide. El
Segundo police routinely check for stolen cars
and suspicious activity using automated license
plate readers. The technology in patrol cars
resulted in 47 arrests in 2020, with the most
common offense being stolen license plates.
Police received 69 reports of residential
burglaries last year. All but five took place in
laundry rooms, carports or mailrooms. Five
homes were burglarized, accounting for just
seven percent of those crimes. Slightly more
businesses were targeted, 103, and construction
sites, gyms and storage facilities were hit most
often. There also were 61 cases of shoplifting,
according to El Segundo Police records.
The city had 32 more violent crimes occur
in 2020 compared to the year before, including
11 rapes and 31 robberies. The number
of aggravated assaults rose by 25 last year,
with 53 incidences of domestic violence and
seven random assaults. Family-friend disputes
accounted for seven of the 72 aggravated-assault
cases in El Segundo in 2020.
No homicides were reported, and a single
case of arson happened. Chief Whalen told the
council that 2020 saw increases in nearly all
crime categories ESPD tracks, adding that violent
crimes committed in El Segundo remain low.
In other action:
• The chairman of the city’s new Diversity,
Equity and Inclusion committee talked about
an incident in El Segundo. A mother reported
her 15-year-old daughter was called a racial slur
by a passing motorist. Shad McFadden said he
spoke with the mother after reading her post on
social media, who confirmed that her daughter
was targeted while walking in town. He also
witnessed how people on Facebook split into
two camps: those who said it happens all the
time vs. others who couldn’t believe something
like that could happen in their town. McFadden
promised council members that the DEI
committee likely will discuss the matter further.
Calling it sad, he said this wasn’t the first
time the girl’s family was verbally targeted by
someone in El Segundo for being dark-skinned.
• The council received an update on the
Regional Park Place Transportation Project and
available funding sources for its construction.
Council members gave the city manager and
staff permission to explore and apply for county,
state or federal grants but asked for more
details later this summer. The public transportation
project will connect segments of Park Place
between Allied Way and Nash Street. The goal
is to provide a continuous roadway from Douglas
to Pacific Coast Highway. The connection
would ease traffic on Rosecrans and create easier
access to the 105 freeway using city streets.
The environmental impact report for the
project was approved in 2019. According to city
documents, the cost to buy the land and construct
the roadways is estimated to reach $100 million.
The Metropolitan Transportation Authority has
committed $10 million to the Park Place project
for planning and construction costs. Also on
the city’s wish list is a second transit initiative
known as the Regional Aviation Boulevard
Bikeway/Greenway Project. The plan calls for
improvements to the eastern entryway to El
Segundo and turning the existing rail line into
walking and biking paths with landscaping.
It’s estimated the Aviation Boulevard work
would cost $10 million and protect students on
bicycles near the Wiseburn campus, as well as
a recreational area to be used by employees in
the offices near the 105 freeway and residents
of Del Aire, who had approached El Segundo
about modernizing the rail spur running along
Aviation Boulevard. •

The City provides its employees with
retirement benefits under the requirements
of the Public Employees Retirement Law,
California Government Code section 20000
et seq. (Retirement Law), pursuant to a
contract, as amended from time to time, it
has entered into with the California Public
Employees Retirement System (CalPERS,
and the CalPERS Contract). The City
has established three pension plans for
its employees, a Miscellaneous Plan (the
“Miscellaneous Plan”), a Safety Police First
Tier Plan (the “Policy First Tier Plan”), and a
Safety Fire Plan (the “Fire Plan”) pursuant to
the CalPERS Contract. The Retirement Law
obligates the City, among other things, to: (1)
make annual contributions to CalPERS to
fund pension and other retirement benefits
for its members and their beneficiaries; (2)
amortize the unfunded accrued actuarial
liability of the City under the Retirement Law,
which is the liability for retirement benefits
that has accrued under the Retirement Law
and the CalPERS Contract but which the
City has not yet paid to CalPERS; and (3)
appropriate funds to pay these obligations.
As of June 30, 2019, based upon the
actuarial reports of pension liability as
calculated by CalPERS with respect to
the Miscellaneous Plan, the Police First
Tier Plan, and the Fire Plan (together,
the “Actuarial Reports”), the City had an
aggregate obligation for its Unfunded
Accrued Actuarial Liability in the amount
of amount of $151,299,753 (consisting of
$34,576,384 for the Miscellaneous Plan,
$61,384,985 for the Police First Tier Plan,
and $55,338,384 for the Fire Plan) pursuant
to the Retirement Law, based on the market
value of assets. The City understands and
believes that, in the current market, it can
issue taxable bonds at a true interest cost

interest cost estimated at 2.73%). Thus, the
City can realize a substantial savings on its
interest expense by issuing the Bonds, using
the proceeds to refund its Unfunded Accrued
Actuarial Liability under the CalPERS
Contract, and thereby pay a lower interest
rate on the Bonds than the rate it would
otherwise have to pay to CalPERS.
On January 19, 2021, after public notice
in accordance with law, the City Council
adopted the Resolution (Resolution No.
5246), entitled, “Resolution Of The City Of
El Segundo, California Providing For The
Issuance Of One Or More Series Of City
Of El Segundo Taxable Pension Obligation
Bonds And Authorizing A Trust Agreement, A
Validation Action And Other Matters Relating
Thereto” (Resolution). A true and correct
copy of the Resolution is attached to the
complaint. Summarized, in the Resolution
the City Council authorized, among other
things, the issuance of one or more series
of pension obligation bonds, and the
execution and delivery of a trust agreement
and supplemental trust agreements in
connection with the issuance of such bonds,
to facilitate the payment of all or a portion of
the City’s unfunded accrued actuarial liability
and, to the extent consistent with the City’s
then-existing local debt policy, the City’s
annual contributions to CalPERS, to fund
pension benefits for its members and their
beneficiaries.
The City brought this validation action to
confirm the validity of this bond transaction
and its terms, as described above and more
specifically in the complaint. The City seeks
an order declaring, among other things,
that the City’s incurrence of any and all
indebtedness and/or liability in connection
with the pension obligation bonds, the City’s
unfunded accrued actuarial liability, and
any annual contribution to CalPERS, as
authorized in the Resolution and pursuant
to the CalPERS Contract, is subject to an
exception, and not otherwise subject, to the
debt limitation set forth in Article XVI, Section
18 of the California Constitution. The Plaintiff
has filed a civil complaint against you. If you
wish to contest the legality or validity of the
matter that is the subject of this lawsuit, you
must appear and file with the Court a written
pleading in response to the Complaint not
later than March 22, 2021. Your pleading
