Insurance companies used the Social Security death list to stop making annuity payments to their deceased customers, according to the California insurance commissioner. This pattern of selective use of the death list indicated to investigators the companies knew policyholders had died, Jones’ office said. State investigators from Florida, North Dakota, New Hampshire and Pennsylvania also discovered that life insurers weren’t using the national Social Security database, called the Death Master List, as the government intended. “Until recently, many life insurers only used the Death Master File for their own economic benefit to identify deceased annuity holders in order to stop making annuity payments, but the life insurers failed to use the Death Master File to identify deceased policyholders in order to pay life insurance benefits,” Insurance Commissioner Jones said. The companies would wait for a claim to be filed for the death benefits, and in some cases when the policyholder who had died stopped paying the premiums, the insurers cancelled the policy and kept the death benefit, Florida Insurance Commissioner Kevin McCarty said in a “60 Minutes” interview. McCarty, who co-led the investigation, dismissed the insurance industry’s argument that the policies state that insurers don’t have an obligation to pay the benefit unless a claim is filed. “And I’m here to say that you have a responsibility to investigate a claim if you know someone has died. And if you have a letter that says you’re deceased, you have actual knowledge the person has died,” he said. The California Controller’s Office also launched its own investigation after it determined that life insurance companies had violated state laws that require unclaimed property held by corporations to be turned over to the State Controller so that the Controller can search for the property owners. Unpaid life insurance benefits qualify as unclaimed property. The life insurers also reached five settlements with states for unlawfully holding unclaimed property, which prevented state controllers from carrying out their legal duties, according to authorities. The five settlements added $2.5 billion to the payouts. California’s Unclaimed Property Law requires corporations, business associations, financial institutions, and insurance companies to annually report and deliver property to the Controller’s Office after three years have passed without any contact with the customer. Investigators continue to watch the insurance companies that weren’t the focus of the probe, and are pushing for full compliance by the industry to use the Death Master List. “We urge the remaining life insurers to follow the lead of the 22 companies that are now using the Death Master File database to search their records for deceased life insurance policyholders and to pay their beneficiaries benefits owed,” Commissioner Jones said in his announcement. “Until they do so, our investigation and enforcement actions will continue.” Missouri Insurance Director John Huff, who is president of the national association of state commissioners, said in an email for this story that his group is working to create a national system for consumers to check on lost life-insurance policies. • Are You Still Paying Too Much For Your Medications?
