In accordance with the provisions of California Public Contract Code §22300, substitution of eligible and equivalent securities for any monies withheld by the District to ensure the Contractor’s performance under the Contract will be permitted at the request and expense of the Contractor. The foregoing notwithstanding, the Bidder to whom the Contract is awarded shall have thirty (30) days following action by the District’s Board of Education to award the Contract to such Bidder to submit its written request to the District to permit the substitution of securities for retention. The failure of the Bidder to make such written request to the District within said thirty (30) day period shall be deemed a waiver of the Bidder’s rights under California Public Contract Code §22300. The proposed project consists of a General Plan Amendment and a Change of Zone for a 0.94 acre property located at 14115 Cordary Avenue (APN 4051- 030-016). The General Plan Amendment would result in a change in the General Plan map from the High Density Residential (HDR) designation to the General Commercial (GC) designation and the Change of Zone would result in a change in the Zoning Map from the Maximum Density Residential (R-4) zone to the General Commercial – Mixed Use Overlay [CG (MU)] zone. The purpose of these proposed amendments are to allow greater flexibility in development types, provide for a development that is consistent with the character of the surrounding uses, and provide a suitable transitional use between the commercial and residential uses in the vicinity. This Initial Study was undertaken for the purpose of deciding whether the project may have a significant effect on the environment. On the basis of such Initial Study, the City’s Staff has concluded that the project will not have a significant effect on the environment, and has therefore prepared a Draft Mitigated Negative Declaration. The Initial Study reflects the independent judgment of the City. The Project is not on a list compiled pursuant to Government Code section 65962.5. At the public hearing held on Wednesday, April 5, 2017, at 6:00 p.m., the Planning Commission will consider the project and make recommendations on the Draft Mitigated Negative Declaration in City Council Chambers, 4455 W 126th Street, Hawthorne, California 90250. If the Planning Commission recommends approval of the project, the project will be advanced to the Decision-making Authority (the City Council). If the Council finds that the project will not have a significant effect on the environment, it may adopt the Mitigated Negative Declaration.
