Pursuant to California Government Code section 36933(c)(1), the City Council has directed the preparation and publication of a summary of Ordinance No. 2128 as follows: Ordinance No. 2128 amends Title 17 (“Zoning”) of the Hawthorne Municipal Code. In sum, the proposed Ordinance increases the minimum project area within the Mixed Use (MU) Overlay Zone and the Mixed Commercial (CM) Classification to 130,680 square feet (three acres) and increases the setback requirements for structures abutting a one or two-story singlefamily or multi-family residential structure located said Zones. It also increases parking and unit size requirements for all residential uses in the City of Hawthorne, including, but not limited to, single family residences and apartments, for bachelor units through four or more bedrooms. It also increases the minimum required commercial floor area for mixed use developments in the City of Hawthorne to 40%. In sum, the proposed Ordinance adds live-work units to the General Commercial (C-3) Zone, renames the Freeway Commercial/Mixed Use (C-1) Zone to Regional Commercial, removes residential uses from the Freeway Commercial/Mixed Use (C-1) Zone, clarifies that non-conforming residential uses are to comply with development standards identified by the Director as most compatible, adds regulations for nonconforming residential structures, adds required findings of approval for conditional use permits, adds required special findings of approval for parking variances, adds provisions related to shared parking agreements, clarifies that vehicle sales are prohibited home occupations, and makes other minor, non-substantive changes. Hawthorne Press Tribune Pub. 11/10/16 HH-25359 Pre-Adoption Summary of Proposed Ordinance 2125 On November 22, 2016 at 6:00 p.m., the City Council of the City of Hawthorne will consider adoption of Ordinance No. 2125, a proposed ordinance repealing and readopting Chapter 5.58 (Massage Establishments) of Division II (Businesses Regulated) of Title 5 (Business Regulation & Licenses) providing reasonable regulations upon massage establishments and amending various provisions of Title 17 (Zoning) to Conditionally Permit Massage Establishments in the C-2 Zone (Local Commercial Classification) Only and Prohibit Massage Establishments in All Other Zones of the City. Pursuant to California Government Code section 36933(c)(1), the City Council has directed the preparation and publication of a summary of Ordinance No. 2125 as follows: This code amendment is proposed in order to comply with the new requirements of Assembly Bill (AB) 1147. The proposed Ordinance will repeal the current Chapter 5.58 (Massage Establishments) and replace it with a new Chapter 5.58 (Massage Establishments). The new Chapter 5.58 will include, but is not limited to, the following provisions: requires that all massage practitioners must be certified under State law; provides that massage establishments are required to obtain a business license pursuant to Chapter 5.06 as well as an “Operator’s Certificate”; requires compliance with numerous operational and facility requirements prior to and during operation as a massage establishment; provides that the Operator’s Certificate must be reviewed and approved by the Police Department; contains suspension and revocation provisions for the Operator’s Certificate; provides numerous prohibitions upon massage establishments including a prohibition of alcohol or drugs on the premises; and allows inspections by City and County officials (Fire Department). In addition, the proposed Ordinance provides that massage establishments will be expressly prohibited in the C-1 Zone (Freeway Commercial/ Mixed Use Classification), C-3 Zone (General Commercial Classification), M-1 Zone (Limited Industrial Classification) and M-2 (Heavy Industrial Classification Massage Establishments will be conditionally permitted in the C-2 Local Commercial Classification, pursuant to the requirements set out in Chapter 17.40 (Conditional Uses—Variances).
