To ensure that the revised bid documents encourage full and open competition, we have asked our FAA Headquarters’ expert in specifications to review the documents and provide comments to the City, which we expect the City to incorporate into the documents.” City officials met with the FAA in mid-June to go over the above “recommendations.” O’Neill said those would likely result in changes to the contracting specifications, but have yet to be finalized. “We are planning to send the FAA something for review by the end of this week or early next week,” he said. “We’re trying to fast-track this to rebid as quickly as possible and we hope to get answers from the FAA in writing on specifications and the deadline.” The goal for “full and open competition” stems from the City receiving relatively few bids for RSI despite advertising the projects nationally. The FAA’s letter mentions that its staff “cautioned the City of El Segundo that their bid documents contained unduly restrictive provisions that could reduce contractor interest and increase costs.” Still, all the bidders for the seven rejected groups had previously completed work on other homes in town for lower amounts. O’Neill could not pinpoint why the last set of bids came in as high as they did. “We are not certain, but we believe the deadline created timing and staffing issues for the contractors— and construction costs in general continue to increase,” he said. “If we rebid the projects and prices come in equally as high, we may not be able to get authorization to award new contracts. The FAA’s letter authorizes us to rebid these seven groups one more time. If we cannot successfully move forward with the contracts, many of the homes will again become ineligible and other homes will be subject to newer requirements.” But O’Neill added that the new FAA specifications could help open the bidding process enough to address the pricing concerns. The “newer requirements” mentioned are not actually available at this point. Los Angeles World Airports (LAWA) has yet to submit criteria for acoustical testing that will be mandatory before any RSI work can proceed after September 30. Of the 191 homes noted above, 60 (groups 62 and 70) are currently in the so-called “green” area that falls within an FAA noise contour map and will remain eligible for future funding even past the end of 2015. The FAA provides 80 percent of the funding for green area homes, with LAWA making up the remainder. O’Neill was hopeful that LAWA will continue to provide its 20 percent for future green area homes. The other 131 homes fall within the “yellow” area of the contour map with all the funding coming from LAWA. “Outside of these 131 homes that are special cases and will hopefully get squared away, funding for the yellow area is ending,” O’Neill said. A 2010 map revision resulted in only 2,500 El Segundo homes being eligible for FAA funding as opposed to 4,500 previously. While it would not permit El Segundo to allocate RSI dollars to the other 2,000 impacted homes, the FAA agreed to allow LAWA to provide 100 percent of the funding for those residences through the end of 2015. Knowing that green area funding would still continue after 2015, the City decided to focus on treating as many of these yellow area homes as possible before the deadline. Although required to maximize the use of FAA funding and a matching 20 percent of LAWA funding in the green area, the City managed to cover 245 yellow homes through the end of 2014, with about 220 (including the 131 noted above) slated for 2015. Based on today’s contour line, over 1,500 yellow area homes will not receive treatment. While yellow area funding will stop, some homeowners currently on the outside looking in may see their fortunes improve thanks to a new LAWA noise map now in the drafting process. “From what I’ve seen, it is different and it appears that it will incorporate more homes than the green area does now so that some yellow homes will ‘turn green’ once the map is finalized,” O’Neill said. Even so, simply falling within a green area won’t guarantee funding for RSI work since the required acoustical testing will ultimately determine if a green home is noisy enough to qualify for improvements. “Once the final map is out and we get the protocol on the acoustical testing from LAWA, we can establish a game plan for the remaining green homes,” O’Neill said, adding that the City intends to conduct extensive outreach to homeowners in those areas. In the meantime, 191 homeowners currently still in limbo can keep their fingers crossed. •
