Environmental Determination An initial study of environmental impacts was prepared pursuant to 14 California Code of Regulations § 15063 (“CEQA Guidelines”). Based on the findings of the Initial Study, the Planning Department has determined that the proposed project has the potential for significant effects related to Aesthetics, Cultural Resources, Geology and Soils, Hydrology and Water Quality, Public Services (Fire, Police, Schools, and Parks), and Transportation/ Traffic, but each of those potential impacts is mitigated to less than significant with the implementation of mitigation measures, therefore a Mitigated Negative Declaration (“MND”) has been prepared pursuant to CEQA § 15070. The MND reflects the independent judgment of City staff and considers project design features, site and surrounding environmental conditions, previous environmental evaluations, standard construction/engineering practices, and potential future projects. Project Description On August 2, 2016, the City Council approved amendments to several sections of the El Segundo Municipal Code, allowed the demolition of an existing 8,195 square foot (gross) restaurant building, and approved construction of three new buildings totaling 13,570 square feet (gross) in area to accommodate 3 restaurants and a bank, along with associated parking. The project was approved with conditions limiting the size of the outdoor dining areas, the number and types of restaurants, and limited the number of off-site parking spaces to 90. The applicant is now requesting to increase the total outdoor dining area from 3,700 square feet, to 4,323 square feet; and increase the number of offsite parking spaces from 90 spaces to 135 spaces, which would be located in the existing parking structure to the north of the site. The applicant is also requesting up to 6 restaurants instead of 3, which would be accommodated within the previously-approved buildings; thus, there will be no increase in the size of the buildings and the project would no longer include a bank building. The applicant’s request includes amending the previously-approved Conditional Use Permit to increase the size of the outdoor dining area; amending the previouslyapproved Administrative Use Permit to allow up to 6 individual restaurants with on-site sale of alcohol; amending the previously-approved Off-Site Parking Covenant to allow the additional required parking to be located in the adjacent parking structure that is owned by the applicant and property owner; and a possible addendum to the previouslyapproved Mitigated Negative Declaration. The requested amendment does not increase the size of the buildings nor the number of buildings; thus, the project site would continue to maintain three buildings measuring a total of 13,570 square feet. Environmental Determination As part of the approval of the original project, an Environmental Assessment No. 1143 was performed and the City Council adopted a Mitigated Negative Declaration (“MND”) pursuant to Section 21080(c) of the Public Resources Code. City staff have determined that the applicant’s proposed amendments to the approved original project are not significant and there is no substantial evidence that the amendments would result in new significant environmental effects, or a substantial increase in the severity of the effects, as previously identified in Environmental Assessment No. 1143 and the Mitigated Negative Declaration. As such, an Addendum (No. 1) to the prior Mitigated Negative Declaration has been prepared since none of the circumstances set forth in the State CEQA Guidelines § 15162 by which subsequent environmental review would be required, exist in this case. The project site is located on a corner lot in the Multi-Family Residential (R-3) Zone on the block bounded by Franklin Avenue to the south, Grand Avenue to the north, Virginia Street to the east, and Whiting Street to the west. The site is currently developed with two residential dwelling units and a detached two-car garage. The existing improvements at the site will be demolished. El Segundo Municipal Code (ESMC) § 15-15-6(A) requires a total of eight parking spaces for the project, including a two-car garage for each unit and two guest parking spaces. The project will provide six semi-subterranean parking spaces in three enclosed twocar garages (one for each unit) and one guest parking space. Access to the semi-subterranean parking level will be from a 12-foot wide driveway and from an existing 14-foot wide alley on the west side of the property. Access to the guest parking space will be directly from the alley. The applicant is requesting a 12.5% reduction to the total number of required parking spaces to provide only one guest parking space, instead of two. Pursuant to ESMC § 15-15-6C(1)(b), the Planning Commission may approve an adjustment when a reduction in parking is greater than 10% and less than 20%. A total of seven parking spaces are proposed for the project instead of the minimum required eight. The proposed project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to 14 California Code of Regulations § 15303 as a Class 3 exemption (New Construction), and § 15332 as a Class 32 exemption (Infill Development). The project will allow the construction of three residential condominium units on a parcel in the Multi-Family Residential (R-3) Zone and will result in a net increase of one additional residential dwelling unit at the site. The proposed development is on a site of not more than five acres surrounded by urban uses. The project is consistent with the City’s General Plan, and is not anticipated to have any significant impacts with regard to traffic, noise, air quality, or water quality. Furthermore, the site has no value as habitat for endangered, rare, or threatened species, and there are adequate utilities, public services and facilities available to serve the project.
