Accessory Dwelling Unit from page 3 “And all of them are working independently to change the language in certain ways. One in particular adds clarity. It’s sort of a clarification bill. And in how they add the clarity, we feel that we may be saved from having to do garage conversions, which is a good thing. So, we want to study that a little longer and then we also want to sort of assess the likelihood that that bill would be approved. We have reason to believe it will be because I think all the cities are asking for that clarity.” City Attorney David King told the Planning Commission his office had received word of the pending new bill just Tuesday and that the new bill was intended “to clarify the scope of the law” and the author’s original intent, which was to not have garages included as ADUs but instead pool houses, studios and the like already existing on a single-family property. At least, that’s the way King’s office reads the pending bill, noting that the bill already passed didn’t specifically say garages could be an ADU but didn’t specifically eliminate them either--and that other parts of the new law included language that included garages. “In particular, I think it’s noteworthy that this recent bill, which came to our office’s attention on Tuesday—it’s coming from the author of the legislation that became the law and so it seems as though there’s an attempt by Assemblymember [Richard] Bloom to clarify the scope of the new law,” said King. “And in particular, the new law doesn’t define accessory structures and what accessory structures would be subject to this ministerial approval process [the new state law put into place] that we talked about last time [at the March 9 meeting] and there was a presumption on all of our parts that the accessory structures included garages because there was other language in the statute that talked about garages in particular---but the new bill only references accessory structures and it gives examples such as pool houses and studios and other similar structures, but it doesn’t say anything about garages. Now, I just want to emphasize that this is just a bill. It’s not law and it’s not an urgency bill, so it could take nine months to get through the approval process. So, as the Planning Manager mentioned, we will evaluate to see the likelihood of success and we’ll definitely look into seeing what the intent was and maybe look into some of the legislative history to see if there was any intent that accessory structures were to cover and include garages. But the language definitely seems to indicate that garages were not necessarily intended to be included as an accessory structure.” McClain also told the Planning Commission that state agencies had “indicated implicitly that garages were included” prior to the introduction of Assemblymember Bloom’s pending bill and called the pending bill “a very, very welcome clarification if it goes through.” Planning Commissioner Scot Nicol asked how the City is currently handling any requests to convert an ADU into a livable unit that had been received since January 1 when the new law took effect. McClain said the City had received two applications to convert ADUs that are not garages or living units into livable units with cooking and plumbing. He said those would be approved within 120 days as required by law. McClain advised members of the public interested in converting an ADU or building a new living unit to consult the Planning Department. He added that if someone came in with an application to convert a garage into a living unit, the City would be “under a lot of pressure to get this ordinance done faster.” •
