Specific language says stairs and elevators are counted once and applied to the first floor and that certain items such as basements; 500 square feet of interior floor area of an attached or detached garage; and first-floor decks, verandas or porches along with uncovered second-floor balconies and decks that are not covered are not included in FAR calculations. Crowley told the Commission that the current code was “carefully thought out” and designed to “minimize the impact on the neighbors. They don’t have any control over the construction other than the City code. So you are here to represent the interests of the neighbors—they’re impacted by developments, they can be… Well, when somebody puts something up next door to you that you don’t like, there’s nothing you’re going to do to get rid of it. So you have to think about this in advance. So, please approach this matter from the standpoint of you’re representing the neighbors. You’re the only people representing how the neighbors are going to be impacted.” Crowley said current code takes into consideration “he obstruction of light and creation of shadow. It can wreck your garden. But quite simply, it changes the mood of how you feel about your house if you’re in shadow.” He cited mold and mildew and privacy issues from second stories as potential harmful impacts if the proposed amendment passed. “The method of second-story wall modulation was chosen as the method to keep neighbors from facing monolithic walls that can and do produce these four types of impacts,” Crowley explained. “Those impacts lower the property values of the neighbors… We’re supposed to be building good neighborhoods here.” Crowley added that “the concept is get the mass in height into the center of the lot and away from the sides” because building a second floor more to one side than the other or too close to one side could “impact the neighbor in a nasty way.” Planning Commissioner Scot Nicol, who is also a real estate agent in the city, said the current code makes it difficult for homeowners to remodel and build a second floor because they have to move out to pour a footing to support the mass of home that has to be built in the center. Said Nicol after Crowley spoke, “I think Mr. Crowley makes some good points. A lot of those points were discussed at the subcommittee… One of the reasons for trying to write a new code that removed modulation was so many of the issues that we were having with plans coming through plan check and staff was architects and engineers working in the city and going up on homes was engineering, how we were going to support that second story with the mass in the center… I feel like the .25 as it’s presented here… the developers don’t even like it because it’s limiting them. They’re not even really able to build the house that they want to build. They would love it to just be .60 and do whatever you want.” Said Planning Commission Chairman Ryan Baldino, who finds the current code “contradictory” and “vague” as well as hard for architects to understand, “An architect shouldn’t have to come to the city and say explain to me what this code means because I don’t know how to build a house in your town. So, simplistic, easy-to-understand—these are the goals we want to use for our codes. It should be self-explanatory for people who want to remodel their home or move into El Segundo and build here to know what they can and cannot do. And I think the goal of reducing the overall mass and to stop these McMansions like we have in Manhattan Beach from coming into El Segundo is achieved by limiting that second story. We allow the flexibility to position it where you want because that could be the purview of the architect and that individual homeowner because it’s not about the developers and the profiteers—it’s about the people who own land here and want to develop and build their homes.” Staff said the amendment will go before City Council two times--once for a reading probably at the first Council meeting in February--and a second time for enactment. Also last Thursday, the Planning Commission unanimously approved permits for Cost Plus World Market and Ralphs Grocery Company to offer onsite wine tasting at their locations on Sepulveda Boulevard and approved the patio expansion of an existing retail space in Continental Development’s The Atrium where Romano Macaroni Grill previously operated at 2321 Rosecrans Avenue.
